A new book from Texas judge Janice Law argues that Lawrence v. Texas, the landmark Supreme Court case that declared anti-sodomy laws unconstitutional, was a staged set-up. . .

This you’ve got to read. I always wondered about the factual details behind that case. It never made sense to me.

Turns out that’s because there were no real facts. And it didn’t make sense.

  1. Wow…I just read that article and am sickened. If this is true, I can’t say I’m surprised.

    And it also reminds me of the case with Terri Schiavo … uncovered mysteries…

    Ridiculous. It absolutely makes sense. The only possible way that this could change the basic ruling is if the state failed to allege waiver of privacy rights in the appellate court. Waiver is itself an argument that can be waived. Rather than blaming the defendants, you should be blaming the prosecutors for messing up here. Of course, the same people who complain about the Lawrence decision no doubt complain about “criminals” getting off the hook as a result of “procedural niceties” as if such things don’t apply to the prosecution.

    Oh, and incidentally, Judge Law is not exactly the shining star of Texas jurisprudence. She became the joke of the Harris County Republican Party after less than one term on the bench and was ousted in a primary the next election.
